Letter of Confirmation for Land Purchase by Thai Citizens Married to Foreigners

 

Thai nationals who are married to foreign spouses, whether the marriage is legally registered or not, must follow the regulations of the Land Department when purchasing land in Thailand. Both spouses are required to jointly confirm in writing that the money used to purchase the land is the personal property of the Thai spouse and not marital property.

If the foreign spouse is unable to sign at the Land Office in Thailand, a Letter of Confirmation from the Land Department must be prepared and authenticated at the Thai Embassy in Stockholm before submitting it to the Land Department.

 

Case 1: If you have documents showing a marital relationship under Thai law or the laws of another country.

The foreign spouse must bring the Letter of Confirmation from the Land Department along with the following documents to the Thai Embassy in Stockholm in person:

Required Documents

  3. Foreign spouse’s passport (original for verification and copies of 2 sets)
  4. Thai spouse’s National ID card (original for verification and copies of 2 sets)
  5. Copy of marriage certificate (2 copies)
  6. Copy of Thai spouse’s house registration/ Tabien Baan (2 copies)
  7. Copies of land-related documents such as land title deeds, sale agreements (2 copies each)
  8. Copy of child’s birth certificate (if applicable) (2 copies)
  9. Copies of any other documents such as name/surname change (if applicable) (2 copies)

 

Case 2: If you do not have documents showing a marital relationship.

In this case, the foreign spouse must have documents certified by relevant authorities in Sweden or Latvia before presenting them to the Thai Embassy in Stockholm for legalization.

The process includes:

Step 1: Fill in the information on the Letter of Confirmation from the Land Department (click to download), then take it to a Notary Public to have the foreign spouse's signature certified (see the list of law offices at hitta.se).

Step 2: Have the document certified by the Ministry of Foreign Affairs of Sweden (for Swedish citizens) or the Ministry of Foreign Affairs of Latvia (for Thai citizens in Latvia).

Step 3: Bring the finalized document to the Royal Thai Embassy in Stockholm for final legalization.

Legalization Fee

  • 180 SEK per stamp (Effective from 5 November 2024). Payment is accepted via Swish only.
